1. Agreement

These Terms are entered into between you and Dayan Itzik, operating under the brand Moonlab ("Moonlab", "we", "us"), a registered sole proprietor in Bat Yam, Israel. By accessing or using the service, you agree to these Terms. If you use the service on behalf of a business, you represent that you are authorized to bind that business, and "you" refers to the business.

2. The service

Moonlab provides hospitality and food businesses with tools to collect customer feedback, manage a loyalty club and deliver benefit codes and confirmations over WhatsApp, together with an owner dashboard.

3. Accounts and access

Access to the business dashboard uses an API key issued to your business. You are responsible for keeping the key confidential and for all activity carried out with it. Notify us promptly if you believe it has been compromised.

4. Subscription and fees

The service is provided as a monthly subscription of $49 per month plus applicable taxes, billed in advance. Payments are processed by our Merchant of Record, which is the seller of record for the transaction. You may cancel at any time; cancellation takes effect at the end of the current billing period and stops future charges. Refunds are governed by our Refund Policy.

5. Your customers' data

Club members join through their own action and explicit consent. You must use the service in compliance with applicable law — including laws governing commercial messages and data protection — and must not upload or solicit data you are not entitled to process. Member data collected through the service is used to operate the service for your business, as described in the Privacy Policy.

6. Acceptable use

You may not use the service for unlawful content or messages, spam, attempts to disrupt or gain unauthorized access to the service, or any use that infringes the rights of others.

7. Availability and changes

The service is provided "as is" and "as available". We may modify, add or remove features, and we do not guarantee uninterrupted availability. Message delivery depends on third-party platforms (including WhatsApp) that are outside our control.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total aggregate liability under these Terms is limited to the fees you paid for the service in the three months preceding the event giving rise to the claim.

9. Termination

You may stop using the service and cancel at any time. We may suspend or terminate access in case of a material breach of these Terms. Sections that by their nature should survive termination survive it.

10. Governing law

These Terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any dispute arising from them.
